PATIALA: The court of Civil Judge Junior Division here has ordered to attach the building of district education office (secondary education) after the state education department failed to comply with court orders on disbursing pension and other retirement benefits to a government lecturer.
Barinder Kaur, a biology lecturer was appointed in 1972 and in 1992 she applied for 90 days leave, but later did not return to the job and remained absent. However, no departmental inquiry was initiated into the matter till she attained retirement age. She then submitted her resignation in 2007 but it was accepted by the education department in 2014. In December 2008, a chargesheet was filed against Barinder and some employees but by then she had attained the age of 58 . For the entire absence period no salary was given to Barinder, who is residing in the USA. It was only in 2013, when she filed a case against her chargesheet and only sought pension benefits, and not any salary for her absence period. She won the case in 2018.
The education department challenged the court’s decision but lost. Later, the department failed to comply with orders, following which the court ordered attachment of property. Barinder became entitled to the pension benefits after she was presumed as retired from government school, Patiala, said advocate Puneet Sharma. However, the education department neither released her pension nor gave her retirement benefits, he added. “ The court, on May 24, issued warrants for attachment of the property of the DEO (secondary), Patiala. If this amount, Rs 40 lakh, payable to Barinder Kaur in terms of her pension, is not released till July 4, then the property will be sold out,” he said.
